Removal of Conditional Residence
If 2 (two) years have passed since you were granted conditional residence through marriage to a U.S. Citizen or permanent resident, you are eligible to waive conditional residence and receive, so called, Permanent Greed Card.*
* The actual filing may take place as early as 21 months after you were granted you conditional
Permanent Residence. If you are still married to the same spouse through whom you gained Conditional Permanent Residence, you must file Petition to Remove Conditions on Residence Form I-751 jointly.
You may apply for waiver of this joint filing requirement if one of the following apply to you**:

- Your spouse had died within the two years that you were conditional resident.
- You entered marriage in good faith, but the marriage was later terminated due to divorce or annulment.
- You had become battered or subjected to extreme cruelty by your U.S. citizen or permanent resident spouse.
- The termination of your status and removal would result in extreme hardship.

Documentation Required
Permanent Resident Card
A copy of your current Green Card (front and back).
Copies of the conditional cards issued to all children in this case.
Evidence of the Relationship
All documents that your consider relevant to demonstrate you maintained mutual household from the date of marriage and to the present time, such as
- Birth certificates of all children born to this marriage.
- Lease or mortgage contacts showing joint occupancy and/or ownership of you communal residence.
- Financial documents showing your joint ownership of assets and joint responsibility for liabilities, such as:
» Joint bank statements;
» Joint income tax returns;
» Insurance policies showing both of your names on them;
» Joint utility bills;
» Other such joint installments and/or loans.

Sworn to or affirmed affidavits from at least two people who have personal knowledge of you since you r conditional residence was granted and your marital relationship. Such statements must contain personal information of the affiants: full name, address, date and place of birth, relationship to you or your spouse, and full information in details how they know you.
- Copy of your marriage certificate.

Filing Fees
- $545 for each adult payable to US CIS
- $80 biometrics fee for each dependent included on the application
Access Legal charges $150 to complete, review, and submit your Petition to Remove Conditions on Residence. This fee includes assistance with any additional information that may be requested by US CIS in connection with your petition. |
