Fiancé(e) Visa


Who may file
You may file for Fiancé(e) Visa if you are:

• a U.S. citizen

• you and your fiancé(e) intend to marry within 90 days of the day your fiancé(e) enters the United States
• both of you are free to marry

• have met in person within 2 (two) years before your filing of this petition*

* There are conditions which may waive this requirement, such as cultural or social practices of your fiancé(e) or extreme hardship to you

Documentation Required

• Proof of U.S. Citizenship: one of the following
  1. Birth certificate
  2. Certificate of Naturalization
  3. Certificate of Citizenship if you gained your citizenship
    through your parents
  4. U.S. passport that was issued for at least 5 years
• Proof that you can legally marry: all of the following
that apply to you
  1. Copies of evidence that you met in person within the last two years, including but not limited to:
    » foreign visas
    » travel tickets
    » photographs of you together
    » other evidence that you consider important to prove your relationship*

    * If you have never met within the last two years, please provide explanation and evidence of the extreme hardship or customary, cultural or social practices that have prohibited your meeting.

  2. Original statements from you and your fiancé(e) that you indeed intend to marry within 90 days upon his/her arrival to the U.S.
  3. Your birth certificates or passports to show that you and your fiancé(e) are of legal age;
  4. If either you or your fiancé(e) were married in the past, give copies of documents showing
    that the prior marriage had legally terminated: one of the following

    » Divorce Decree or Certificate
    » Annulment
    » Death Certificate

• Photographs
  1. One passport size color photo of you showing full frontal view and taken within 30 days
    of the date your petition is signed.
  2. One passport size color photo of your fiancé(e) showing full frontal view and taken
    within 30 days of the date your petition is signed.

  • $455.00 – payable to US CIS*

*Access Legal charges $450 to complete, review, and submit your Alien Fiancé(e) Petition.
